Greetings to the good gentles of the Known World from Ellisif Flakkari,
the Committee to Save Our Society, and the mandamus petitioners!

As you know, the Superior Court of California awarded legal and court costs
to the petitioners who sought to require the SCA, Inc. to obey its bylaws
and open the financial records for review by members.  This award, in the
amount of $19,220.38, was made on the request of the petitioners and
without objection by the representatives of the corporation at a hearing
on 8 September.  The court issued its payment order on 23 September; as I 
write, the corporation is still in violation of that court order.

In its executive session last month, the Board reportedly voted to ask the
petitioners to accept a long-term payment plan at a rate of $1000 per
month.  As you no doubt recall, the petitioners offered the Board a payment
plan as part of a settlement package negotiated through the month of August
with Lee Forgue.  The payment plan and other concessions were offered in 
exchange for the Board's agreement to open corporate publications and 
kingdom newsletters to paid advertising regarding legitimate impeachment
campaigns, to provide a means of mailing information about impeachment, 
and to guarantee members' permanent right to full disclosure of financial
information.  The Board refused to accept our offered settlement, 
preferring to fight the court battle to the bloody end.  Shortly after the
Board broke off negotiations, the court found in favor of the petitioners
on all points and then awarded full costs to the petitioners.  Only now, 
after ignoring the court order for several weeks, has the Board deigned to 
offer delayed payment.

The delayed-payment offer was received by our attorney on 25 October with
the remarkable added threat that the corporation would file for Chapter 11
bankruptcy if the petitioners did not accept the offer.  It is ludicrous to
believe that Mr. Johns, the corporate counsel, took it upon himself to 
transform an offer into an ultimatum; such behavior could get him disbarred.
That decision must have been made by the director or directors who instructed
Mr. Johns.  Either the person who gave Mr. Johns these instructions grossly 
exceeded his authority (and must be sanctioned by the corporation), or the 
board as a whole has chosen a misguided path of threats and bluster.  To
the best of our knowledge, the board did not authorize this threat.  Any 
director who deliberately subverts the Board's decisions is clearly unfit 
to serve and should be removed from office; any board that deliberately 
subverts the society it is meant to serve by engaging in such activities is
clearly unfit.   Either way, we demand to know who is responsible for this 
outrage, and we demand that the Board remove all directors responsible.

The bankruptcy threat is absurd on the face of it: According to our attorney, 
a member of the California Bar with years of experience in these matters, 
simply to file for Chapter 11 bankruptcy would cost $15,000 *more* than 
the total amount owed to the petitioners.  Whoever the directors were who 
invented this threat, they clearly have no idea what bankruptcy entails: 
The court would control all SCA, Inc. assets, could liquidate and 
consolidate them for its own convenience, and would proceed in the best
interests of the corporation's creditors -- of whom the petitioners are 
probably the most significant!  Furthermore, since we have already received
copies of the financial records of the corporation, we know full well that
satisfying the court order will not bankrupt the corporation.  Thus, one 
can conclude only that one or more directors invented the threat of 
bankruptcy solely to intimidate the petitioners into waiving their rights.

Not surprisingly, the petitioners have refused unanimously to cave in to
blustering and bullying threats.  We offered compromise when compromise was
appropriate, when it would have been advantageous to both parties, before 
the court decided the matter.  The corporation was unwilling even to give 
formal consideration to our offer of settlement: Mr. Tatro, Chairman of
the Board, refused to convene a meeting so that a vote could be taken.  
Now he and the Board ask the petitioners to make a $20,000 interest-free 
unsecured loan to the corporation, while our legal costs continue to mount.
We cannot afford such a luxury; we have bills to pay, and our attorney quite
rightly expects the money he's earned.  The delays and threats by the 
corporation have already cost us additional money that we will have to 
pay or extract from the corporation.

The corporation is in violation of a court order, and has made it clear
that it will go to extreme lengths to avoid its legal obligations.  At least
one director is willing to mis-represent the Board's decisions in order to 
duck his legal obligations.  These actions endanger the corporation and the
individual directors: Our attorney feels that there is clear cause for the
corporation and the individual directors to be cited and sanctioned for
contempt of court.  If the corporation persists in refusing to pay its
bills, the petitioners may have no choice but to ask the court to intervene
by attaching the corporate bank accounts or by recovering the judgement
from the directors personally.

We do not want to do this, but we have very little alternative at this
point.  Given that the corporation, based on its own financial information,
*can* pay the bill, it is not even a question of whether we should sacrifice
ourselves for the corporate good.  It is a question of whether we shall 
permit whichever directors have ordered this action to extort concessions
and bankrupt the mandamus petitioners.  We will not allow this.

When the Board was presented with a $67,000 bill for incomplete and unusable
computer software, they paid it without hestitation.  When the Board was 
presented with a bill for Provine's services, they paid it without 
hesitation.  When the Board was presented with a bill for *their* lawyers'
services in the mandamus action, they paid it without hesitation.  Why is 
it that the only bill the Board refuses to pay is the judgment for attorney's
fees and court costs which Judge Levinger has said they must pay because
they put the petitioners and the Society through a legal battle which never
should have happened?  This seems like more of the "I won't do it and you 
can't make me" nonsense that got the Board into this situation in the 
first place -- if the Board hadn't taken this attitude toward showing 
members the books of account, they wouldn't be under a court order to pay
fees and costs now.

At any time, the corporation can pay this debt.  It does not take a Board 
meeting.  It merely requires that the President or the Treasurer authorize 
the expenditure.  They have had nearly two months since the hearing, and a 
full scheduled Board meeting, to discuss the matter.  Surely the Board must
have decided by now.

In the real world, people who defer their bills get notices from collection
companies.  We would hate to take this step, butthe corporation has left us
no choice.

Enough is enough.  Will the Society condone gross misconduct by directors?
We say no, and we demand action.  We expect immediate payment of this bill
in full; further, we expect the directors responsible for this abuse of
power to be sanctioned.  The Board meets by teleconference on 9 November.
We will all be waiting to hear how they deal with this outrage.

is wildly worng at worst, and confusing Chapter 11 Bankruptcy with
Chapter 7 Bankruptcy at best.

Chapter 11 is a legitimate business strategy for reorganization and
debt consolidation.  It is frequently used when one or more creditors
refuse to renegotiate debt or are placing unreasonable demands upon a
corporation.  The Corporation still controls all its own assets and
makes all its own business decisions, and the only way the bankruptcy
courts can "liquidate and consolidate them for its own convenience" is
by rolling the corporation over into Chapter 7 Bankruptcy -- which can
be done, but isn't done often.

As to the costs involved, filing Chapter 11 bankruptcy costs $750 in
court fees, plus the time of an accountant and an attorney to assemble
the proper papers.  Assuming that the corporate records are in any
sort of order, this might add another five thousand dollars to the
price tag.

I happen to run a corporation (incorporated in California and
Massachusetts) that filed Chapter 11 bankruptcy in May of 1993.  We're
still in business, and the SCA, Inc. probably would be also -- if they
followed that route.

problemet med waiversarna. i och med det s} betalade jag inte in till SCA
d} heller och nu n{r det verkar ha l|sts sig s} t{nkte jag betala och }ter
f} ett medlemskort. 
Jag har blanketten d{r det st}r $15 och allt, problemet {r att waivern som
finns p} den verkar vara den som inte gillades och slutade g{lla.

Lady Heloise har helt raett. Dessutom, aeven i fraaga om kaempar, "Makterna" 
inkl den amerikanska styrelsen (BoD) aer numera medvetna om att det haer med 
Waiver aer ett problem. Enligt en medlem i BoD:s waiverkommitte betraktar de 
sig f n inte kompetenta att formulera en internationellt giltig waiver; 
utredning paagaar. Om jag minns raett saa aer den senaste policyn fraan 
Drachenwald att vi ska vaenta tills det kommer en europeisk version av 
waivern. 
Saa kaenner naagon sig manad att foernya sitt medlemskap, kan ni mycket vael 
goera det utan att skriva paa naagon "viftare". 
Daeremot vill ovannaemnda kommitte gaerna ha aasikter (helst sakkunniga) 
i aerendet, och soeker framfoer allt kontakt med intresserade jurister

Jag fyllde inte i min waiver i iv}ras och jag fick ett bl{tt
medlemskort {nd}. Jag hade fyllt i en f|rra g}ngen tyckte dom, men
d} fick jag ett gult medlemskort. Som vanligt verkar dom inte veta vad
dom sysslar med borta i usa.

Men det {r ju bara dom som t{nker }ka till usa som beh|ver bry sig om
waivern. Den saknar v{rde i sverige. I sverige g{ller svensk r{tt och
inget annat.

Greetings to the good gentles of the Known World, from Baron Hossein Ali 
Qomi, the Committee to Save Our Society, and the Mandamus Petitioners.

It is our pleasure to announce that the Board of Directors of the SCA, Inc. 
have issued a check in the full amount of the fees and court costs judgment 
related to the Mandamus action.  We have now received confirmation that 
attorney for the petitioners received that check on November 5.

We are highly pleased that the Board has finally decided to act responsibly,
and regret the amount of popular pressure which has been required to bring 
about that outcome.  We are deeply grateful to Ed Kreyling, Lee Forgue, and 
John Fulton for their tireless and unstinting efforts at resolving this 
situation. We look forward to working with them and with the rest of the 
Board as we continue to resolve the few remaining issues in the Mandamus 
action.

          If the Board feels that the SCA cannot pay this bill in one
          lump sum, it should not negotiate directly with the
          creditor.  Instead the Board should submit a repayment plan
          to the Judge for the Judge's approval.  If the judge
          approves a monthly repayment plan with appropriate interest
          then the creditors will have to live with that.  Filing for
          bankruptcy would not be necessary.

Jag har l{st "lite" juridik och har diskuterat denna sak med n}gra
av mina l{rare. Slutsatsen {r att man givetvis inte ska skriva under
waivern, men om man skulle ha r}kat skriva under den s} l{r man

Tyv{rr Styrbj|rn, man kan inte vara hur dum som helst n{r man skriver 
p} n}got. Den tolkning som jag citerade av punkt tre i 'waivern' {r 
inte min, den {r gjord av en jurist som jag kontaktade just betr{ffande
om denna 'waiver' var laglig. Hans bed|mning var att den {r det.
Ing}nget avtal g{ller tills det sagts upp.

Nu {r ju fr}gan hursomhelst |verspelad, denna 'waiver' {r indragen och
ingen ny har kommit i dess st{lle. BoD har f|r |vrigt l}tit bland annat
Drachenwald formulera egna 'waivers', arbetet l{r p}g} just nu. 
Finns det n}gon jurist eller lagkunnig som vill l{ggga synpunkter p} 
utformningen borde de nog kontakta Drachenwalds drots snarast. Hon 
l{r i alla fall inte fr}ga efter andras }sikter, s} det {r v{l lika bra
att framf|ra dem oombedd!

Ingen jag har haft den {ran med att konversera med p} det stora n{tet
Rialto har varit roade av stora signaturer eller extensivt citerande
av tidigare inl{gg; d{remot har ett flertal varit ondgjort sig |ver
dylikt bruk.

Till yttermera visso rekommenderas i det m}natliga utskicket p} Rialto
om "Netiquette" just att man trimmar ned citaten och inte f|rser sina
inl{gg med stora signaturer.

Sj{lv har jag alltid beundrat formen p} inl{ggen fr}n Arval Benicoeur
(som {ven kallar sig Arval d'Nord), i det att han signerar med endast
2 rader (!), och trimmar ned citaten till ett minimum.  Fullt
tillr{ckligt f|r att se vem som skrivit vad.

	Har foeljt debatten om 'waivern' paa NML. Aen saa laenge gaeller
medlemskap foer att deltaga i kaempaleker i Drachenwald, eventuella aendringar

	Vad gaeller sk 'rimligt' saa aer den diskutionen egentligen
helt ointressant. Det finns i Sverige regler foer foereningar som aegnar
sig att kampsporter, det blir dessa regler som (enl. mina advokatvaenner)
kommer att tilllaempas om det leder till raettsfall.

	Grunden foer bedoemning aer att man naer man tar paa sig rustning
foar att slaass, eller paa annat saett deltager i aktivitet av detta slag,
saa aer man medveten om att det finns en skaderisk. Marskarnas kontroll
av utrustning har _ingen_ inbyggd garanti eller saa. Deltagaren aer sjaelv
ansvarig....saa skoet om din utrustning...;)

	Ett intressant fall att foelja blir det med de personer som
aadragit sig skador i hockeyrinkar nyligen. Dessa personer aer endast
publik, men enligt vad vi nu vet kommer de ej att kunna kraeva naagot
direkt skadestaand....vi faar vael se..?!

BoD drog tillbaka kravet paa medlemskap foer deltagande i
stridrelaterade aktiviteter, just naer Middle Kingdom hade gjort det
till lag. AEr detta lag i Drachenwald, eller 'policy'?

'Waivern' var aldrig avsedd att skydda kaemparna, den var avsedd att
skydda SCA,inc. Anledningen till protesterna mot punkt tre i "Provines
Waiver" var att man aatog sig att ersaetta SCA foer krav fraan tredje
part!

Att tro att det inte spelar naagon roll om man skriver paa en 'waiver'
eller inte eftersom de inte gaeller i Sverige kan vara ett misstag. Om
du aer medlem i en 'corporation' baserad i Californien kan du aatalas
enligt Californisk lag, enligt en USAmerikansk jurist jag brevvaexlat
med. Foer att nu inte tala om vad som kan haenda om man besoeker till
exempel Pennsic....

Skriv inte under naagot du inte aer saeker paa att du kan staa foer!

I don't have a problem with the information(my delete button works very 
well).  I just don't really like the CSOS. In Calontir, we have been
deluged by many, many posts from CSOS members and have grown weary of it.

I didn't mean to cause offense with my offhanded remark and if I have done
so I apologize.  I just thought that the song(written by a friend here in
Calontir)) might be of amusement to everyone in Nordmark.

Well, in Nordmark we have not. Here, we definitely haven't had a "deluge" of 
information, opinions etc on the current mess from any source, CSOS or 
otherwise. I don't know if you have a problem with _all_ reform-related 
information reposted to Nordmark, or only with that from CSOS, or if you don't 
notice the difference. I happen to feel that Nordmarkers have a right to know 
when somebody is trying to con them out of their money or f--- with them in 
other ways, and as long as I have good reasons to believe that the information 
is reliable, I get it from whatever sources I can and pass it on.
If you don't want this information, as you say, your delete button works fine. 
If you think that this information is tendentious and wrong, you are free to 
argue the matter. Personal attacks and name-calling, which is what the song 
contains, are not appropriate means, at least not in my book.

Obviously not to everyone. I can see the song in its context, with Calontir 
people being fed up with what they see as propaganda interfering with their 
playing. Please understand that our context is different. Your sympathies may

Catrin, 
I think you and I are both on the same side(correct me if I'm wrong).  I don't 
feel that the actions of the CSOS were necessary and may have been taken to the
extreme.  The cost of the lawsuit vs. the gains of it don't equal out(IMO).  
On the Calontir list we have had, I think, a lot more stuff posted by Hussain and
the other CSOS people.  I agree that everyone has a right to know  when they   
 							     ^^^^^	
are being cheated out of their money.  I am not, nor ever will be an advocate
of censorship of any kind.  The passing of information is an important thing
and needs to continue.

:::sigh::: you are right, even though I have lived in Sweden for about 10 months
total now, your context is different from mine.  There are somethings that I will
really *never* understand that are uniquely Swedish and uniquely Nordmark.  
I forget that sometimes and need to watch the cultural differences. 

In Calontir if we don't like something or if we like something, or even if we
just feel like it we write songs.  I saw this song as being a satire on what 
is going on with the CSOS and took what it said with a grain of salt.  I 
thought this would be a little amusing/satrical for you to see.  I did not
intend this to be a personal attack at all.  Well, so far two people have told 
me that I'm wrong and I apologize for any mis-understandings.  I will, of 
course, respect your opinon on this issue. 

How about we say this one is a difference in cultures, both mundance and sca.
Your right my sympathies are with Nordmark and Drachenwald, but my heart and 
home is in Calontir.

Salve allihopsens...

P} Rialto har det varit debatter och diskussioner om hur man egentligen
f}r kl{ och smycka sig, s} kallade sumptuary laws.
Debatten har fr{mst handlat om Kronor av olika slag (crowns, coronets och
circlets) samt om b{lten och kedjor. I vissa delar av den k{nda v{rlden
verkar det brukligt f|r v{pnare att ha kedjor och sporrar i silver.

Nu undrar jag om det i Drachenwald finns lokala regler f|r vilka typer av
smycken, kl{desplagg och andra accessoarer en person f}r b{ra oavsett rang
och s}?

Kan n}gon svara p} detta???

Kanske, kanske inte. BoD har ju klantat sig till den grad att en hel del 
amerikaner ocks} {r heligt f|rbannade p} dem och saker och ting kan h{nda. 
BoD sitter inte fastsvetsade d{r de sitter, de {r inte en enda individ med 
en enda }sikt, och Corpora {r inte hugget i sten - bara n{stan!!!

F|rresten, Drachenwalds nya ombudsman i BoD heter Eilis O'Boirne (Lee 
Forgue), hon n}s via e-mail p} eilis@haas.berkeley.edu och hon tycks vara 
villig att ta till sig folks }sikter (det i sig {r en revolution inom BoD).

Min kaere Morgan, hur kan du ha faatt allting saa komplett om
bakfoten? I egenskap av svenskar, ljusets riddarvakt, aerans
och hjaeltarnas folk (och daermed oeverlaegsna alla dessa
utlaendska skymningsvarelser) aer det givetvis vi som bestaemmer.
Dumma regler aer till foer... att tjaena som foerevaendning foer
machubernahme! :-)
